These Terms and Conditions ("Terms") govern your access to and use of LeadIntent.ai, including any related applications, software, and services (collectively, the "Service") provided by Moonshot Technologies ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must not access or use the Service. We recommend that you print a copy of these Terms for future reference.
2. Changes to Terms
We reserve the right to modify these Terms at any time. If we make changes, we will provide notice of such changes, such as by sending an email notification, providing notice through the Service, or updating the "Last Updated" date at the beginning of these Terms. Your continued use of the Service following notification of changes confirms your acceptance of our revised Terms.
3. Account Registration and Security
3.1 Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.
3.3 Account Restrictions
We reserve the right to disable any user account at any time, including if you have failed to comply with any of the provisions of these Terms, or if activities occur on your account which, in our sole discretion, would or might cause damage to or impair the Service or infringe or violate any third party rights, or violate any applicable laws or regulations.
4. Service Description and Limitations
4.1 LinkedIn Data Extraction
LeadIntent.ai enables users to extract LinkedIn engagement data (reactions and comments) from public LinkedIn profiles, including details about users who engaged with those profiles. The Service is designed to help generate leads for sales, recruitment, or business development.
4.2 Usage Limitations
Your use of the Service is subject to the following limitations:
You may only extract data from public LinkedIn profiles.
You may only use the Service in accordance with LinkedIn's terms of service.
We reserve the right to impose usage limits on the Service, such as the number of profiles or posts that can be analyzed within a given time period.
4.3 No Guarantee of Availability
We do not guarantee that the Service, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw, discontinue, or change all or any part of the Service without notice. We will not be liable to you if for any reason the Service is unavailable at any time or for any period.
5. Subscriptions and Payment
5.1 Subscription Plans
Access to the Service may require payment of fees according to our subscription plans. By subscribing to a paid plan, you agree to pay all fees in accordance with the pricing and billing terms in effect at the time of your subscription.
5.2 Billing
We will bill you through the payment method you specify in your account. By providing a payment method, you authorize us to charge you using that payment method for the Service.
5.3 Automatic Renewal
Unless otherwise provided, subscriptions automatically renew at the end of each billing period. You authorize us to charge your payment method for the subscription fees for each renewal period until you cancel.
5.4 Cancellation
You may cancel your subscription at any time. Cancellation will be effective at the end of your current billing period. As stated in our Refund Policy, we do not provide refunds for any unused portion of a subscription period.
5.5 Changes to Pricing
We reserve the right to adjust pricing for the Service at any time. If we change pricing, we will provide notice of such change at least 30 days before the change takes effect. Your continued use of the Service after the price change becomes effective constitutes your agreement to pay the changed amount.
6. Intellectual Property Rights
6.1 Our Intellectual Property
The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by us, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
6.2 License to Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your internal business purposes.
6.3 Restrictions
You shall not:
Modify, copy, or create derivative works based on the Service or any part thereof.
Reverse engineer, decompile, or disassemble the Service or any part thereof.
Access the Service in order to build a similar or competitive product or service.
Use the Service in any manner that could disable, overburden, damage, or impair the Service or interfere with any other party's use of the Service.
7. User Content and Conduct
7.1 User Content
Any content you submit to or through the Service ("User Content") remains your property. By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display the User Content in connection with operating and providing the Service.
7.2 Prohibited Content
You may not submit or share content that:
Infringes or violates the intellectual property rights or any other rights of others.
Violates any law or regulation.
Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable.
Contains any viruses, malware, or other harmful code.
7.3 Prohibited Conduct
You agree not to:
Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
Engage in automated scraping of LinkedIn beyond what is provided by the Service.
Share your account credentials with any third party.
Use the Service to harm, threaten, or harass another person, organization, or us.
Interfere with or disrupt the Service or servers or networks connected to the Service.
8. LinkedIn Terms Compliance
8.1 LinkedIn's Terms of Service
You acknowledge that your use of the Service must comply with LinkedIn's terms of service. You are responsible for ensuring that your use of data obtained through our Service complies with LinkedIn's terms.
8.2 Compliance with LinkedIn Policies
We design our Service to comply with LinkedIn's policies regarding data extraction. However, LinkedIn may change its policies at any time. If LinkedIn changes its policies in a way that affects our Service, we may need to modify or discontinue certain features of the Service, and we will not be liable to you for such modifications or discontinuations.
8.3 No API Access Guarantee
The Service relies on publicly available data and does not claim to have special access to LinkedIn's API. LinkedIn may restrict access to its platform at any time, which could affect the functionality of our Service.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
We make no warranty that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness, or reliability of any information or content on the Service.
10. Limitation of Liability
IN NO EVENT SHALL WE, OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR CONTENT PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
11. Indemnification
You agree to defend, indemnify, and hold harmless us, our affiliates, licensors, and service providers, and our and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without giving effect to any principles of conflicts of law. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Nagpur, Maharashtra, India, and you hereby consent to the personal jurisdiction and venue there.
13. Termination
We may terminate or suspend your access to all or part of the Service, with or without notice, for any conduct that we, in our sole discretion, believe violates these Terms, is harmful to other users of the Service, us, or third parties, or for any other reason.
14. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
15. Entire Agreement
These Terms, our Privacy Policy, and our Refund Policy constitute the entire agreement between you and us regarding the Service and supersede any prior agreements between you and us relating to the Service.
